On November 29, 2022, the Federal Energy Regulatory Commission (FERC) issued an order accepting the PJM Interconnection, L.L.C. (PJM) filing to comprehensively reform its interconnection process.
In a pair of orders issued on October 20, 2022, the Federal Energy Regulatory Commission (FERC) expanded its definition of affiliation and control significantly. FERC found that, for purposes of section 203 of the Federal Power Act (FPA) and FERC's regulations for utilities with authority to sell electricity at market-based rates, an investor that nominates or appoints its own officer, director, or other appointee accountable to that investor to a utility or utility holding company's board has control of, and should be considered an affiliate of, that utility or utility holding company.
